Beta, Early Access

Beta Services. Certain features may be offered in beta, early access form and are provided for evaluation purposes only (“Preview Features”). Use of such Preview Features is voluntary and at the User’s sole risk. Preview Features may be incomplete, unsupported, modified, suspended, or discontinued at any time without notice and may not perform at the same level of reliability or availability as the standard Services.

ALL PREVIEW FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANNERSNACK DISCLAIMS ALL LIABILITY ARISING FROM OR RELATING TO PREVIEW FEATURES, AND SHALL HAVE NO INDEMNIFICATION OBLIGATIONS IN CONNECTION THEREWITH; WHERE LIABILITY CANNOT BE EXCLUDED, IT SHALL BE LIMITED TO USD 500.

Free Trial

Where a Team Subscription Plan includes a free trial, access to the Services may be provided at no cost for a limited evaluation period. 

Free trials are offered solely for assessment purposes and may be modified, suspended, discontinued or terminated by Bannersnack at any time, at its sole discretion, without notice or liability.

API Terms

Access to an application programming interface (“API”) may be made available by Bannersnack under these Terms. Use of the API is additionally governed by the then-applicable API-specific terms.

Bannersnack may, at any time and without liability, modify, restrict, suspend, or terminate access to the API, in whole or in part, with or without prior notice.

White-Label

The Services may include a white label functionality that allows the User to present certain elements of the Services under its own branding, subject to these Terms and any additional white label terms made available by Bannersnack, as updated from time to time at Bannersnack’ sole discretion. In the event of any conflict between these Terms and the applicable white label terms, the latter shall prevail.

Bannersnack reserves the right, at any time and without liability, to modify, suspend, or discontinue the white label functionality (in whole or in part), with or without notice. The white label features may be updated or changed periodically, and the User is solely responsible for ensuring that its use remains compatible with the then-current version of the applicable terms and technical requirements.

Support

We provide support services to our Users, subject to the features, limitations, and conditions of the applicable Subscription Plan, from time to time.
